USER AGREEMENT
This document is a legally binding agreement between the User and the Platform.
1. GENERAL PROVISIONS
This Agreement governs the use of the AliJurist.net platform (hereinafter referred to as the "Platform"). By using the Platform, the User confirms that:
* familiar with the conditions;
* agrees with them;
* has the right to conclude contracts.
This User Agreement (hereinafter referred to as the "Agreement") defines the procedure for accessing and using theAliJurist.net online platform (here in after referred to as the"Platform"), and also regulates the rights, obligations and responsibilities of persons using the Platform.
By using the Platform, registering, creating an account, or using any functionality of the Platform, a person confirms that:
* have fully read the terms of this Agreement;
* understands the content and legal consequences of its provisions;
* unconditionally and fully agrees to the terms of the Agreement;
* has the necessary civil capacity and the legal right to enter into legally binding contracts;
* uses the Platform voluntarily and at your own risk.
Definition of terms
User — any individual, individual entrepreneur or legal entity who accesses the Platform, uses its functionality, views information, registers an account or otherwise interacts with the Platform.
Client — A User who places a request, searches for a Contractor, orders, plans to order, or receives services from the Contractor through the Platform.
Contractor — A User who posts information about himself and his services, offers, provides or intends to provide services to Clients through the Platform. The Contractor is solely responsible for the legality of his activities, the availability of necessary permits, licenses, certificates, qualifications and compliance with the requirements of the legislation of Ukraine.
The Platform is an exclusively technological and informationalonline service that provides the ability to post, search and exchange information between Users.
Platform:
* is not a party to contracts, agreements or legal relationships between Clients and Contractors;
* does not act as an employer, agent, representative, intermediary, guarantor, partner or trustee of any User;
* does not organize or control the process of providing services;
* does not guarantee the quality, legality, effectiveness or compliance of services with the Client's expectations;
* is not responsible for actions, omissions, violations, errors or inaccurate information provided by Users.
All decisions regarding cooperation, conclusion of contracts, transfer of funds, documents or personal data are made by Users independently, voluntarily and at their own risk.
2. STATUS AND ROLE OF THE PLATFORM
The platform is exclusively an informational online service .
* The platform operates on an "as is" basis . We do notguarantee uninterrupted operation or the absence of technical errors.
* The platform does not provide legal or other professional services.
* The Platform is not a party to agreements between Clients and Contractors.
* The platform does not act as an agent, intermediary or representative.
3. USERS AND INTERACTIONS
The platform provides access for Clients and Contractors(lawyers, accountants, private notaries, private executors, specialists in providing security services and installing alarms, auditors, experts, insurers, teachers, psychologists, doctors andother professionals, etc.).
* All agreements are concluded directly between the Client and the Contractor.
* The platform does not control the content of the agreements and does not guarantee their implementation.
4. FINANCIAL CONDITIONS AND REMUNERATION, PAID SERVICES
* Payment for services is made directly between the Client and the Contractor.
* The Contractor pays the Platform a service access fee of 10% of the cost of services received from clients attracted through the Platform.
* It is prohibited to negotiate outside the system after establishing contact on the Platform in order to avoid paying the service fee.
* The platform can provide on a paid basis :
- advertising;
- raising the profile ;
- premium access ;
- analytical tools .
5. LIMITATION OF LIABILITY
* The platform does not check the licenses, diplomas or real experience of the Performers (unless otherwise expressly stated). The user independently assesses the risks.
* The platform is not responsible for the quality of the services provided, the Client's financial losses, lost court cases, or mistakes of specialists.
* The maximum liability of the Platform for any claims is limited to the amount that the User actually paid to the Platform over the last 3 months. If the services were free of charge, the liability is limited to the amount of 20 tax-free incomes of citizens, but not more than 500 UAH.
* All disputes are resolved exclusively on an individual basis.
6. PRIVACY AND GDPR
* We process your data (name, phone number, e- mail, etc.) inaccordance with the Privacy Policy and the Law of Ukraine "On the Protection of Personal Data".
* You have the right to request the deletion of your data ("right to be forgotten") by sending a support request, the deadline for fulfilling this request is 1 month.
7. SANCTIONS, PROHIBITIONS AND DISPUTE RESOLUTION
* The Platform has the right to block the Contractor's account for violating the terms (in particular, for concealing agreements).
* Before going to court, a mandatory claim procedure is established (30 days for a response).
* Prohibition of circumvention of the Platform, protected by :
- bypass the Platform to avoid payment;
- negotiate outside the system after establishing contact with theCustomer.
- conclude contracts outside the system.
* The legislation of Ukraine applies.
